Indian Point Units 2&3 are a pair of 1000 megawatt nuclear reactors in Buchanan , New York, formerly owned by Con Ed and the New York Power Authority. Both reactors were purchased by Entergy. Indian Point was one of the three plants in included in the Hudson River Settlement Agreement (HRSA).

After a decade of bureaucratic delay, we won the opportunity to compel four once-through cooled Hudson River power plants to modernize their antiquated intakes, which collectively withdraw one trillion gallons per year. These facilities (Indian Point, Roseton, Bowline, and Danskammer) operate on permits which expired in 1992. In November, Riverkeeper led a coalition in filing a lawsuit to force DEC to reconsider the permits. With our assistance, Assemblyman Richard Brodsky and others brought a similar petition over Indian Point. Together, these suits prompted the state to commit to reconsider the four permits in 2003. The adjudicatory hearings on these draft permits, the first since the late 1970s, will determine the fate of the fishery for the foreseeable future and set national precedent on cooling technology and fisheries population modeling.

As a result of Riverkeeper\'s lawsuits, DEC is issuing new permits for four existing power plants on the Hudson River, including Indian Point. On April 9, 2003, Judge Keegan determined to order DEC to issue an Indian Point draft SPDES permit by November 14, 2003.
