Onofry dismissed a lawsuit filed by Danskammer Energy LLC, seeking to overturn the Department of Environmental Conservation’s denial of a permit necessary for Danskammer to build a new fracked gas plant on the banks of the Hudson River in Orange County. New York State’s Department of Environmental Conservation (DEC) said on Wednesday that two proposed fracked gas power plants —— Astoria NRG in Queens and Danskammer in Newburgh, Orange County —— appear to be “inconsistent with or would interfere with the attainment of the Statewide GHG emission limits” established in the Climate Leadership and Community Protection Act.
