Public meeting: Advanced Notice of Proposed Rule Making – Saline Water Reclassification

DEC filed an Advanced Notice of Proposed Rule Making (ANPRM) with the New York State Department of State on July 27, 2022. The ANPRM is a data gathering and public outreach exercise intended to inform future reclassification and water quality standard rule makings applicable to saline waters of the State, if appropriate. Saline waters potentially subject to reclassification are found in 6 NYCRR Parts 859, 864, 885, 890, 891, 920, 921, 922, 923, 924, 925, and 935. A full list of waters subject to possible reclassification is included in Table 1 of the ANPRM document (PDF). The effort may also result in amendments to water quality standards found in 6 NYCRR Parts 700-703.

The public notice of the ANPRM starts a 90-day data solicitation period where stakeholders may submit data to DEC in response to the ANPRM and the questions posed within it. The data solicitation period will close at midnight on October 25, 2022.

The ANPRM is not a regulatory action, but an opportunity to gather stakeholder data to inform future regulatory changes, if appropriate. As such, there are no regulatory impacts and no need for a rule making hearing.

ANPRM Public Information Meetings
DEC plans to hold two public information meetings in support of the ANPRM. These are not hearings, but opportunities for stakeholders to learn about the ANPRM process and ask questions about the data DEC seeks in response to the ANPRM.

People who want to ask questions of DEC regarding the ANPRM will have the opportunity to do so at the public webinar. Any person wishing to ask a question(s) must register in advance of the meeting no later than 10:00 a.m. Monday, August 29, 2022. Any person who wishes only to observe the webinar online must also register. Any person may listen to the meeting by phone without pre-registration.

To register electronically: People who will login to the meeting electronically must register at http://www.webex.com. Click “Join,” input the event number listed above, click “Register,” and fill in the requested information. You will be asked whether you wish to make a public statement or not. After registration is complete, you will receive a confirmation by email with information about how to join the meeting.

To register by telephone: Any person who is not able to login electronically may participate by telephone. Call-in participants must register to speak in advance by calling DEC at 518-402-9003 no later than 10:00 a.m. Monday, August 29, 2022. Please provide your first and last name, address, email address if any, and telephone number and reference the “ANPRM public information meeting.”

All participants will be muted upon entry into the meeting. The meeting moderator will call each person who has requested to ask a question(s) to speak. The meeting moderator will continue the meeting until everyone wishing to speak has been heard or other reasonable arrangements have been made to include their questions in the record. Reasonable time limits may be set for each speaker as necessary to afford all participants an opportunity to be heard. The webinar meeting will be recorded and posted to this webpage shortly after the conclusion of Meeting #1.

No pre-registration is required for the in-person meeting. The opportunity to ask questions of DEC regarding the ANPRM will be afforded at the in-person meeting, similar to the webinar.
